LEGAL
Forensic Disclaimer
Last updated: May 28, 2026
DMVForensics is a private professional service provider, not a law enforcement agency, government entity, or licensed private investigator in all contexts. Our work is fundamentally different from a police investigation.
1. Scope of Our Services
We provide technical digital forensics and data recovery services to private individuals, families, small businesses, attorneys, and insurers. Our typical work includes:
- Forensic imaging and preservation of digital devices
- Recovery of deleted or hidden data
- Timeline reconstruction and activity analysis
- Written reports suitable for personal understanding, insurance claims, or civil proceedings
We do not have arrest powers, cannot execute search warrants, and do not operate under governmental authority.
2. Not a Substitute for Law Enforcement
If you believe a crime has been committed — especially involving minors, threats of violence, financial crimes, or ongoing harm — you should contact the appropriate law enforcement agency (local police, FBI, or ICAC task force) immediately.
Our Services are intended primarily for personal peace of mind, civil/family matters, insurance claims, and situations where you want documented evidence without necessarily involving police. We will never discourage you from contacting law enforcement.
3. Court Admissibility & Legal Proceedings
- Our reports and forensic images are prepared using professional standards and documented chain of custody.
- However, we cannot and do not guarantee that any report, image, or testimony will be admitted as evidence in any court or administrative proceeding.
- Admissibility is always determined by the judge, the rules of evidence in the specific jurisdiction, opposing counsel objections, and the complete factual history of the devices (including how they were handled before we arrived).
- For matters expected to go to court, we strongly recommend that you involve a qualified attorney early. Attorneys can help preserve privilege, issue proper legal holds, and coordinate with us for maximum evidentiary value.
- We are happy to work with your attorney and can provide expert testimony when pre-arranged (additional fees apply).
4. Criminal vs. Civil / Personal Matters
In cases with clear criminal implications, our findings may be valuable background, but law enforcement will typically need to conduct their own independent forensic examination using their own tools and procedures to support prosecution.
We can assist attorneys in civil litigation, family law (e.g., custody or infidelity matters), estate disputes, and business matters where documented digital evidence is helpful.
5. No Guarantee of Findings or Recovery
While we use best-in-class tools and techniques, we cannot guarantee recovery of all deleted data, identification of every actor, or that hidden information will be found. Device encryption, secure deletion tools, hardware failure, or passage of time can limit results. You will still be responsible for payment for work performed.
6. Attorney Involvement Recommended for High-Stakes Matters
If your situation involves potential litigation, divorce, child custody, large financial stakes, or any possibility of criminal exposure, consult an attorney before or at the same time as engaging our services. We can coordinate directly with counsel.
7. Acknowledgment
By proceeding with an engagement or submitting the intake form, you acknowledge that you have read and understand this Forensic Disclaimer, that DMVForensics is a private service provider, and that you have been advised to contact law enforcement and/or an attorney where appropriate.
